Whilst I agree about the "Bat" sentiment, fecking disgusting behaviour, that is the danger of giving money to a Ltd company. At most, they are only worth whatever the called up share capital is, typically £100. If it goes belly up, unless you start the winding up order, or are a known creditor to the administrator appointed to effect the wind up, post day in court, you are not entitled to a penny. If they have no assets to "fire sale" to cover creditors (first paid is Administrator, then HMRC, then whoever else is on the list), then there is no money. The reason he is listed twice as "Director" is one will be for him as Director, and the other for him as Company Secretary. The only long term route, would be potentially expensive civil litigation to have him struck off from companies house, get him banned as a director. Then he would be only able to operate as a self employed entity, and if he then goes owing people money, you can civil prosecute against his personal assets, house, car, cash etc. Limited company status offers a company a hell of a lot of protection from going bust, and having claims against that company's director's personal assets going forward. Without doing a Winding Up Order (c. £1880 to form petition to high court) or instigating a CCJ (c. £60) whilst the Ltd Co. is trading, you have no chance. Sorry.

Could get him struck off from being allowed to be a Co. Director, thus leaving him as a sole trader/self employed, and then any personal assets would then be up for grabs if he does his tricks again.

I m in contact with lawyer in UK , seems that it's not so easy that Stravens may think to rob people .
I will follow this until I get my money back or what I ordered from him. So I keep the faith , Justice+Karma will do the Job |

I wish you luck, but if Stravens Audio is a dissolved UK Limited company, to which you paid money, I don't know what will come of it.
All of this is in the civil courts, which is expensive, and very open to the whim of the court. If you could get the Police interested enough to investigate whether he was doing it with intent, i.e. a fraud has occured, then you may be able to get a criminal case, which the CPS would fund. However, UK Police are not overly fond of looking at what appears to be a civil case, as it buggers the crime statistics, and they have only a low chance of actually getting a conviction. Good luck.

I would advise caution, there are many solicitors/lawyers who will tell you they can recover the money for you, but all they want you to do is give them money. They are usually just debt collectors, who will send letters asking for the money, and the other party wont pay. You could very easily end up losing more money to the solicitor. Check them out before you give them any money, as there are some bad eggs in the industry. I had a similar situation myself, lost money to a limited company that was wound up, and 3 weeks later saw some of my stock on display at a trade show and heard it was being sold for cash out the back of a van. I couldn't prove any of this, and I had a 'solicitor' promising they could get all my money back. They wanted about £600 and then a percentage of the money recovered. When I looked into it, they would have just taken my £600 and written a couple of letters threatening legal action hoping to scare someone into responding, and that's about it. Unless you can prove Fraud or other similar wrongdoing, there is very little you can do to a limited company. My advise is, if you are sending money to someone, and you have no way of being sure about them, pay with Paypal or a Credit Card. If they cant take Paypal or Credit Card, they are a risk. If they do, you are protected. Paypal is best, and nobody really has any reason for not accepting paypal. |

Not a nice situation. Definitely need to speak to a solicitor if you intend to follow up on it.
How did you pay for the products? you definitely have invoices,etc? Might have waited too long since ordering but at very least talk to your bank, or hopefully you paid by credit card which is insured on most things. uk court can reinstate a dissolved company with a court order so it's not as straight forward as that, but it's complicated and can be costly. Depends how far you want to go. If he has done it to others then try to get as much detail as possible for a pattern of fraud. A company tried to strike off and not pay a debt owed to me and others a few years back, they knew what they were doing I managed to stop them and it caused them massive headaches until they worked out it was easier just to pay. I hope it works out. |
